LIABILITY WAIVER, RELEASE OF CLAIMS & ASSUMPTION OF RISK AGREEMENT

ACKNOWLEDGEMENT OF RISKS

I understand that participation in golf simulator activities, multisport simulator activities, and use of the facilities at On Par Simulation Lounge involves inherent risks, including but not limited to:

Being struck by golf clubs, balls, equipment, or other flying objects
Slipping, tripping, falling, or colliding with walls, furniture, equipment, or other guests
Injuries caused by swinging golf clubs in confined or shared spaces
Equipment malfunction or misuse
Injuries related to intoxication or impaired judgment
Risks associated with participation in sports simulation activities
Risks associated with alcoholic beverage consumption
Property damage or personal injury caused by other patrons I understand that these risks may result in serious bodily injury, permanent disability, death, or property damage.

ASSUMPTION OF RISK

I voluntarily assume all risks associated with entering or using the facilities, equipment, simulator bays, tap wall areas, seating areas, and all related activities at On Par Simulation Lounge, whether known or unknown, foreseeable or unforeseeable. I acknowledge that golf simulator bays involve limited-space swinging activity and require constant awareness of surrounding individuals and objects.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue On Par Simulation Lounge LLC, its owners, officers, employees, contractors, affiliates, agents, successors, and assigns from any and all claims, liabilities, damages, demands, actions, or causes of action arising out of or related to:

Personal injury
Death
Property damage
Losses arising from use of the facility
Negligence of other participants
Ordinary negligence of On Par Simulation Lounge.

This release applies whether injuries occur inside simulator bays, lounge areas, tap wall areas, entrances/exits, restrooms, or anywhere on the premises.

RESPONSIBILITY FOR DAMAGE

I agree to use all simulator equipment, launch monitors, screens, projectors, clubs, furniture, tablets, kiosks, tap wall equipment, and other property responsibly and safely. I understand that I may be held financially responsible for damage caused by:

Reckless conduct
Intentional misuse
Horseplay
Throwing clubs or objects
Negligent or abusive behavior
Failure to follow staff instructions

I authorize On Par Simulation Lounge to charge the payment method on file for damage caused by myself or members of my party resulting from prohibited or reckless conduct.

RULES & SAFETY COMPLIANCE

I agree to:

Follow all posted rules and staff instructions
Remain aware of my surroundings while swinging clubs
Keep spectators outside designated swing zones
Refrain from dangerous, reckless, violent, or disruptive conduct
Avoid use of equipment while intoxicated or impaired

On Par Simulation Lounge reserves the right to remove any guest without refund for unsafe, disruptive, or abusive behavior.

ALCOHOL ACKNOWLEDGEMENT

I understand alcoholic beverages may be consumed on the premises. I agree to consume responsibly and acknowledge that alcohol consumption may impair judgment, coordination, reaction time, and the ability to safely participate in simulator activities or operate a motor vehicle. I accept full personal responsibility for my conduct and decisions while consuming alcohol, including my decision to drive or arrange transportation following my visit. I understand that participation in simulator activities while under the influence of alcohol may increase the risk of injury to myself and others. I understand On Par Simulation Lounge reserves the right to refuse alcohol service to any individual for any lawful reason, including visible intoxication, unsafe behavior, disruptive conduct, or violation of facility rules.

MEDICAL AUTHORIZATION

In the event of an emergency, I authorize On Par Simulation Lounge personnel to obtain medical assistance on my behalf. I understand I am solely responsible for any resulting medical expenses.

MINORS

Any parent or legal guardian signing on behalf of a minor agrees to all terms of this agreement and accepts full responsibility for the minor’s conduct, supervision, participation, and any resulting damages or injuries.

MINOR GUEST & SUPERVISION POLICY

Guests under the age of 16 must be accompanied and supervised at all times by a parent or legal guardian while on the premises. Guests ages 16–17 may use the facility without a parent or legal guardian only if a parent or legal guardian has completed and signed all required waiver documentation in advance and emergency contact information is provided. Parents and legal guardians accept full responsibility for the conduct, supervision, safety, and any damages caused by minors in their party. On Par Simulation Lounge reserves the right to refuse entry, suspend play, or remove guests from the premises for violation of minor supervision policies or unsafe conduct.

PHOTO & VIDEO RELEASE (OPTIONAL)

I grant On Par Simulation Lounge permission to use photographs or video footage taken on the premises for promotional or marketing purposes unless I notify staff otherwise in writing.

GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Arkansas. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
